Former President Donald Trump is requesting a judge to have special counsel Jack Smith redact more of his presidential immunity brief before it is released to the public. Trump’s attorneys argued that unredacted information in the latest court filing by Smith was done for political reasons and accused prosecutors of wanting their “politically motivated manifesto” to be public in the final month of the 2024 election.
The immunity filing, containing evidence related to criminal charges against Trump, remains under seal. The Supreme Court ruled that presidents have some immunity from criminal prosecution and ordered a reevaluation of Smith’s charges against Trump based on this new definition.
Smith plans to submit a comprehensive argument to the court, containing new evidence against Trump. Trump’s attorneys oppose this, arguing that the case may be tossed out entirely. The decision on when to unseal Smith’s filing remains with the judge.
The document is expected to reveal unflattering moments from Trump’s 2020 election campaign but Trump’s attorneys argue that the redactions do not adequately protect privacy concerns for witnesses.
